RESOURCE CENTER

Straight answers to the questions injured Texans ask most.

Most people have never dealt with a serious injury claim before. This page explains how the process works in Texas, what to watch out for, and when to get help. It’s general information, not legal advice for your situation. For that, call Josh directly.

What To Do After Any Serious Accident

  1. Get medical care right away and follow your doctor’s treatment plan.
  2. Report it to the police, property owner, or employer, and get a copy of the report.
  3. Photograph everything: the scene, vehicles or hazards, and your injuries.
  4. Get witness names and phone numbers.
  5. Keep evidence: damaged products, clothing, shoes, and safety gear.
  6. Don’t give a recorded statement to the other side’s insurance company.
  7. Don’t post about it on social media.
  8. Don’t sign anything until you’ve talked to a lawyer.

Don’t Wait — Deadlines Apply

Every claim has a legal deadline to file, and some are much shorter than people expect, especially claims involving a government vehicle, property, or employee, which can require written notice within months. Missing a deadline can end a claim permanently. The deadline in your case depends on your specific facts, so talk to a lawyer as soon as possible.

Frequently Asked Questions

Do I need a lawyer?

Not always. For minor injuries that heal quickly, you may be able to handle the claim yourself. If you have a serious injury, ongoing treatment, lost income, a commercial vehicle, or a dispute about fault, talking to a lawyer early usually protects you. Josh will tell you honestly if you don’t need one.

How much does a lawyer cost?

Personal injury cases are handled on a contingency fee. You pay nothing up front, and there’s no attorney’s fee unless money is recovered for you. The firm advances all case expenses. They are repaid from the recovery, and if there is no recovery, you owe nothing. Fee terms are explained in writing before you sign.

What is my case worth?

It depends on the injuries, the medical treatment, lost income, how clearly the other side is at fault, and the available insurance. Anyone who gives you a number at the first meeting is guessing. A realistic value comes after the facts and medical records are gathered.

How long will my case take?

Many cases resolve within months after treatment ends. Cases that go to suit can take one to two years or more. Settling before you know the full extent of your injuries is usually a mistake.

Who pays my medical bills while the case is pending?

Your health insurance, PIP coverage, or medical payments coverage may pay first. Some providers will treat you under a letter of protection and be paid from the settlement. We help you figure out the options.

What if I was partly at fault?

Texas uses proportionate responsibility. You can recover if you were 50 percent or less at fault, and your recovery is reduced by your percentage.

Should I talk to the other driver’s insurance company?

You can report the claim, but you don’t have to give a recorded statement, and you shouldn’t before talking to a lawyer.

Will my case go to trial?

Most cases settle. Preparing every case as if it will be tried is what leads to fair settlements.

Who will handle my case?

Josh Hopkins, personally. You’ll have his direct number.

Do you speak Spanish?

Sí. Se habla español.
